SUBJECT: PARTIAL WIND UP COSTS

Summary:

Consumers filed a hearing request with the Tribunal in respect of the Notice of Proposal issued by the Superintendent related to a partial wind-up it had filed. After a settlement conference Consumers withdrew its request for a hearing and submitted a revised partial wind-up report. United Steelworkers requested the Tribunal to order Consumers to pay the union’s costs.

The Tribunal did not award costs in favour of the union. Consumers was not unreasonable, frivolous or vexatious, and in fact the Tribunal found that it always appeared reasonable, cooperative, and helpful to the Tribunal. The change of position taken by Consumers created some delay in the proceedings, but the Tribunal was not convinced that the delay was unnecessary or unreasonable.

Consumers a déposé une demande d’audience auprPs du Tribunal concernant l’avis de proposition émis par la Surintendante relativement B une liquidation partielle déposée par la société. AprPs une conférence de rPglement, Consumers a retiré sa demande d’audience et a déposé un rapport de liquidation partielle révisé. Les Métallurgistes unis d’Amérique ont demandé au Tribunal d’obliger Consumers B régler les frais du syndicat.

Le Tribunal n’a pas attribué les dépens au syndicat. En effet, Consumers n’a pas adopté une conduite déraisonnable, frivole ou vexatoire. En fait, le Tribunal a déterminé que la société s’était toujours montrée raisonnable, coopérative et obligeante B son égard. Le changement de position de Consumers a retardé l’instance, mais le Tribunal n’était pas convaincu que le délai était inutile ou déraisonnable.
