SUBJECT: SURVIVOR PENSION BENEFITS

Summary:

This was a hearing requested by Brewers Retail Inc. in relation to a Notice of Proposal (NOP) dated March 12, 1992 issued by the Superintendent of Pensions to Brewers Retail Inc., proposing to order the administrator to make certain adjustments to the pension benefits paid to the spouse of a deceased former retired employee and member of the Brewers Retail Pension Plan for Bargaining Unit Employees.

The union, the Brewers Retail and the United Brewers Warehousing Workers' Provincial Board, although served with the Notice of Hearing, did not appear or take any position in the hearing.

The Commission determined that the calculation method stipulated by the Brewers Retail Pension Plan for Bargaining Unit Employees was incorrectly applied by the Applicant. Thus, the Applicant was required to comply with the Superintendent’s order to increase the pension being paid to the spouse sixty percent (60%) of the pension benefits which was being paid to her husband at the time of his death.

The Commission dismissed the Application brought by Brewers Retail Inc. for an Order reversing the Decision of the Superintendent of Pensions as set out in the Revised Notice of Proposal to Make an Order dated March 12, 1992 and ordered the Superintendent of Pensions to carry out the Proposed Order dated March 12, 1992.

The Commission was aware that the ruling would require Brewers Retail Inc. to recalculate the pension entitlement of the spouse and perhaps others in a similar position. However inconvenient that may be for Brewers Retail, it stated that it must fulfil its fiduciary responsibilities to plan beneficiaries to ensure they receive benefits to which the Pension Plan provisions clearly entitle them.

Cette audience tenue B la demande de Brewers Retail Inc. portait sur un avis d’intention, mis le 12 mars 1992 par le Surintendant des rgimes de retraite B Brewers Retail Inc., d’ordonner B l’administrateur d’apporter certaines modifications aux prestations de survivant verses B l’pouse d’un ancien employ retrait dcd et participant du rgime de retraite des employs de l’unit de ngociation de Brewers Retail.

L’avis a t signifi au syndicat, B Brewers Retail et B la United Brewers Warehousing Workers' Provincial Board mais ils ne se sont pas prsents B l’audience et n’ont pris aucune position.

La Commission a dtermin que le demandeur avait incorrectement appliqu la mthode de calcul stipule par le rgime de retraite des employs de l’unit de ngociation de Brewers Retail et qu’il devait, par consquent, se conformer B l’ordonnance du Surintendant et hausser la rente verse B l’pouse de soixante pour cent (60%) des prestations de retraite verses B son poux au moment de son dcPs.

La Commission a rejet la requLte prsente par Brewers Retail Inc. en vue d’obtenir une ordonnance annulant la dcision du Surintendant des rgimes de retraite nonce dans l’avis rvis d’intention de rendre une ordonnance dat le 12 mars 1992 et a ordonn au Surintendant des rgimes de retraite de donner suite B l’ordonnance propose date le 12 mars 1992.

La Commission savait que la dcision obligerait Brewers Retail Inc. B recalculer le droit B pension de l’pouse et, peut-Ltre, d’autres personnes dans une situation semblable. Elle a dclar que, aussi malcommode que cela puisse Ltre pour Brewers Retail, celle-ci tait tenue de respecter ses responsabilits fiduciaires B l’gard des bnficiaires du rgime et de faire en sorte qu’ils reoivent les prestations auxquelles ils ont clairement droit en vertu des dispositions du rgime.
