SUBJECT: PARTIAL WIND UP COSTS

Summary:

Consumers filed a hearing request with the Tribunal in respect of the Notice of Proposal issued by the Superintendent related to a partial wind-up it had filed. After a settlement conference Consumers withdrew its request for a hearing and submitted a revised partial wind-up report. United Steelworkers requested the Tribunal to order Consumers to pay the union’s costs.

The Tribunal did not award costs in favour of the union. Consumers was not unreasonable, frivolous or vexatious, and in fact the Tribunal found that it always appeared reasonable, cooperative, and helpful to the Tribunal. The change of position taken by Consumers created some delay in the proceedings, but the Tribunal was not convinced that the delay was unnecessary or unreasonable.

Consumers a dpos une demande d’audience auprPs du Tribunal concernant l’avis de proposition mis par la Surintendante relativement B une liquidation partielle dpose par la socit. AprPs une confrence de rPglement, Consumers a retir sa demande d’audience et a dpos un rapport de liquidation partielle rvis. Les Mtallurgistes unis d’Amrique ont demand au Tribunal d’obliger Consumers B rgler les frais du syndicat.

Le Tribunal n’a pas attribu les dpens au syndicat. En effet, Consumers n’a pas adopt une conduite draisonnable, frivole ou vexatoire. En fait, le Tribunal a dtermin que la socit s’tait toujours montre raisonnable, cooprative et obligeante B son gard. Le changement de position de Consumers a retard l’instance, mais le Tribunal n’tait pas convaincu que le dlai tait inutile ou draisonnable.
